1. PURPOSE AND SCOPE
These general terms and conditions govern the sale of travel packages between the Organiser and a traveller purchasing for purposes unrelated to their trade, business, craft or profession. Pursuant to Article 33 of the Italian Tourism Code, a travel package consists of a combination of at least two different types of travel services (passenger transport, accommodation, vehicle rental or other tourist services such as guided tours, admission tickets and tastings) for the purpose of the same trip or holiday. Other tourist services combined with only one transport, accommodation or vehicle rental service constitute a package only if they account for a significant proportion of the value of the combination or represent an essential feature thereof. Pursuant to Article 32(2)(a) of the Italian Tourism Code, packages lasting less than 24 hours which do not include overnight accommodation are excluded.
2. LEGAL FRAMEWORK
The sale of travel packages covering services provided in Italy or abroad is governed by Articles 32–51-novies of Italian Legislative Decree No. 79 of 23 May 2011 (the “Tourism Code”), as amended by Legislative Decree No. 62 of 21 May 2018 implementing Directive (EU) 2015/2302, by these general terms and conditions and, insofar as applicable, by Italian Law No. 1084 of 27 December 1977 (International Convention on the Travel Contract – CCV) and the provisions of the Italian Civil Code.
3. DEFINITIONS
For the purposes of these general terms and conditions:
a) “Organiser” means the trader who combines packages and sells or offers them for sale, whether directly, through or together with another trader;
b) “Retailer” means a trader other than the Organiser who sells or offers for sale packages combined by an Organiser;
c) “Traveller” means any person who intends to conclude a contract, concludes a contract or is entitled to travel on the basis of a contract concluded;
d) “Durable medium” means any instrument enabling the Traveller or trader to store information addressed personally to them in a way accessible for future reference for a period adequate for the purposes of the information, and allowing the unchanged reproduction of the information stored;
e) “Unavoidable and extraordinary circumstances” means a situation beyond the control of the party invoking it, the consequences of which could not have been avoided even if all reasonable measures had been taken;
f) “Lack of conformity” means a failure to perform or improper performance of the travel services included in a package.
4. PRE-CONTRACTUAL INFORMATION AND PACKAGE DETAILS
Before conclusion of the contract, the Organiser provides the Traveller with the standard information form and the information required under Article 34 of the Tourism Code. These form an integral part of the contract and may not be altered except by express agreement between the parties (Article 35). Information on the suitability of the trip for persons with reduced mobility is provided in the package description; the Traveller may request more precise information before booking. Package details: Organiser R.A.M.A. S.p.A. (details set out above); the programme and package description are valid for the periods specified therein; the criteria for price adjustments are set out in Article 7; the terms for transferring the contract are set out in Article 14. At the time the contract is concluded, the Organiser informs the Traveller of the identity of the operating air carrier, where applicable, pursuant to Article 11 of Regulation (EC) No. 2111/2005. The processing of personal data is described in the privacy notice attached to the contract.
5. BOOKING AND CONCLUSION OF THE CONTRACT
The proposed contract is drawn up using the appropriate form, which may be electronic, completed in full and submitted by the Traveller. The contract is concluded only when the Organiser sends the relevant confirmation to the Traveller, including by electronic means. At the time of conclusion of the contract or immediately thereafter, the Organiser provides the Traveller with a copy or confirmation of the contract on a durable medium (Article 36 of the Tourism Code). The confirmation includes: the names of the Travellers; arrival and departure dates; number and types of rooms; a description of the included services and accommodation; prices, supplements and discounts. The Traveller accepts these conditions also in the name and on behalf of the participants listed. In good time before the start of the package, the Organiser supplies the Traveller with the necessary receipts, vouchers and travel documents, together with information on scheduled times (Article 36(8) of the Tourism Code). Contracts concluded at a distance are not subject to the right of withdrawal under the Italian Consumer Code (Article 47 of Legislative Decree No. 206/2005). For contracts negotiated away from business premises, the Traveller may withdraw within 5 days of conclusion of the contract, or of receipt of the contractual terms and preliminary information if later, without penalty and without stating a reason, except in the case of offers at rates significantly lower than current offers (Article 41(7) of the Tourism Code). All prices are expressed in euros and include VAT where applicable. Ancillary agreements and amendments to the contract require written confirmation from the Organiser. Communications are sent to the email address supplied by the Traveller when booking and are deemed received if correctly sent to that address.
6. PAYMENTS
Within 3 (three) days of the Organiser’s confirmation, the Traveller pays 30% (thirty per cent) of the total trip price as a confirmatory deposit (caparra confirmatoria). The effects provided for in Article 1385 of the Italian Civil Code do not apply where the Traveller withdraws for a reason not attributable to them or because of unavoidable and extraordinary circumstances (Article 11), or where withdrawal is justified by a serious breach by the Organiser, nor where the Organiser terminates the contract due to unavoidable and extraordinary circumstances or failure to reach the minimum number of participants (Article 12): in these cases the Traveller is entitled to a full refund of all amounts paid. The balance, equal to 70% of the price, must be paid without further reminder no later than 30 (thirty) days before the start of the trip or, for boat trips, 50 (fifty) days before the start. For bookings made within 30 days of the start of the trip, the full price must be paid in a single instalment at the time of confirmation. Payments may be made by credit card, where this option is available on the tour page, or by bank transfer to: RAMA S.p.A. – IBAN IT47J0885114301000000311012 – BIC/SWIFT ICRAITRRNN0 – Banca Tema, Via Unione Sovietica 42, 58100 Grosseto, Italy. After making the bank transfer, the Traveller is requested to email a PDF copy of the payment confirmation to travel@rama1913.it. Any bank charges are payable by the Traveller. Once the balance has been received, travel documents will be sent by email no later than 2 (two) weeks before the start of the trip. Failure to pay the amounts due by the specified deadlines, except in cases of force majeure, constitutes an express termination clause under Article 1456 of the Italian Civil Code: termination takes effect upon simple written notice from the Organiser, without prejudice to the right to claim damages.
7. PRICE AND PRICE ADJUSTMENTS
The package price is established in the contract, with reference to the price indicated on the website, in the catalogue or in the programme outside the catalogue. After conclusion of the contract, the price may be increased up to 20 (twenty) days before the start of the package solely as a result of changes in:
a) the cost of passenger transport resulting from the cost of fuel or other energy sources;
b) the level of taxes or fees on the travel services included in the contract imposed by third parties not directly involved in the performance of the package, including landing taxes or embarkation and disembarkation fees at ports and airports;
c) the exchange rates relevant to the package. Changes are calculated by reference to the costs and exchange rates in force on the date of publication of the programme or the subsequent updates indicated. The Traveller is notified of the increase on a durable medium at least 20 days before the start of the package, together with its justification and calculation. If the increase exceeds 8% of the total price, Article 8 applies: the Traveller may accept the increase or terminate the contract without penalty and receive a full refund. The Traveller is entitled to a price reduction corresponding to any decrease in the above costs occurring after conclusion of the contract and before the start of the package; in such a case, the Organiser may deduct the administrative expenses actually incurred, providing evidence of them upon request.
8. CHANGES TO THE PACKAGE BEFORE DEPARTURE
Before the start of the package, the Organiser may unilaterally change contractual terms other than the price only if the change is insignificant, informing the Traveller on a durable medium. If the Organiser is compelled to alter significantly one or more main characteristics of the travel services, is unable to fulfil accepted special requests or increases the price by more than 8%, the Organiser shall inform the Traveller without delay on a durable medium, specifying the proposed changes and their impact on the price. The Traveller may accept the change or terminate the contract without penalty; upon termination, the Traveller has the rights provided for in Article 9. The Traveller must communicate their decision within 2 (two) working days of receiving the notice; if no response is received within that period, the change is deemed accepted.
9. TRAVELLER’S RIGHTS IN THE EVENT OF WITHDRAWAL OR CANCELLATION
If the Traveller terminates the contract in the circumstances provided for in Articles 7 and 8, or if the Organiser cancels the package before departure for any reason not attributable to the Traveller, the Traveller is entitled, alternatively, to:
a) a replacement package of equivalent or higher quality at no additional cost, or a lower-quality package with a refund of the price difference;
b) a refund of all payments made, without undue delay and in any event within 14 (fourteen) days of withdrawal or cancellation. Where applicable, the Traveller is also entitled to compensation for damages, unless the cancellation results from failure to reach the minimum number of participants (Article 12) or from unavoidable and extraordinary circumstances (Article 11).
10. WITHDRAWAL BY THE TRAVELLER AND CANCELLATION CHARGES
The Traveller may terminate the contract at any time before the start of the package. Outside the circumstances provided for in Articles 8, 9 and 11, an appropriate and justifiable cancellation charge shall apply, calculated as follows:
a) withdrawal up to 30 days before the start of the trip: 30% of the total price, plus any non-refundable costs already incurred (e.g. museum admission tickets and other services);
b) withdrawal between 29 and 20 days before the start of the trip: 50% of the total price;
c) withdrawal between 19 and 8 days before the start of the trip: 90% of the total price;
d) withdrawal from the 7th day before the start of the trip, failure to arrive (no-show), or interruption of a trip already commenced: 100% of the total price. Boat trips:
a) withdrawal up to 50 days before the start of the trip: 30% of the total price, plus any non-refundable costs already incurred;
b) withdrawal between 49 and 40 days before the start: 50%;
c) withdrawal between 39 and 30 days before the start: 60%;
d) withdrawal between 29 and 20 days before the start: 80%;
e) withdrawal from the 19th day before the start of the trip or interruption of a trip already commenced: 100% of the total price. Notice of withdrawal must be given in writing by email to travel@rama1913.it; the date of receipt shall be decisive. At the Traveller’s request, the Organiser shall justify the amount of the cancellation charge.
11. UNAVOIDABLE AND EXTRAORDINARY CIRCUMSTANCES
In the event of unavoidable and extraordinary circumstances occurring at the destination or in its immediate vicinity and significantly affecting the performance of the package or the carriage of passengers to the destination, the Traveller has the right to terminate the contract before the start of the package without paying any termination fee, and to receive a full refund of all payments made, but no additional compensation (Article 41(4) of the Tourism Code). Under the same circumstances, the Organiser may terminate the contract and refund all payments received, without additional compensation, by notifying the Traveller without undue delay before the start of the package.
12. MINIMUM NUMBER OF PARTICIPANTS
Where a package requires a minimum number of participants, this is stated in the package description together with the deadline by which the Organiser may terminate the contract. If the minimum number is not reached, the Organiser may terminate the contract and fully refund the payments received, without additional compensation, by notifying the Traveller on a durable medium within the stated deadline and, in any event, no later than: 20 days before the start of the package for trips lasting more than 6 days; 7 days before the start for trips lasting between 2 and 6 days; and 48 hours before the start for trips lasting less than 2 days (Article 41(5)(a) of the Tourism Code).
13. CHANGES AFTER DEPARTURE AND ASSISTANCE
If, after departure, a substantial proportion of the services cannot be provided as agreed, the Organiser shall offer suitable alternative arrangements for continuation of the trip at no extra cost; if these alternatives result in services of lower quality, the Organiser shall grant the Traveller an appropriate price reduction. The Traveller may reject the alternative arrangements only if they are not comparable to what was agreed or if the price reduction is inadequate. If no alternative arrangements can be made, or if the Traveller rejects them for a justified reason, the Organiser shall provide equivalent transport, at no additional cost, for the Traveller’s return to the point of departure or another agreed location, and shall refund the difference between the cost of the services originally envisaged and those actually provided up to the early return. The Organiser shall provide appropriate assistance without undue delay to a Traveller in difficulty (Article 45 of the Tourism Code).
14. TRANSFER OF THE CONTRACT AND CHANGES REQUESTED BY THE TRAVELLER
The Traveller may transfer the contract to a third party who meets all the conditions applicable to the package, by notifying the Organiser on a durable medium no later than 7 (seven) days before the start of the package and providing the transferee’s details (Article 38 of the Tourism Code). The transferor and transferee are jointly and severally liable for payment of the outstanding balance and any fees, taxes and other additional costs arising from the transfer, including administrative and processing charges, evidence of which the Organiser shall provide upon request. Requests by the Traveller to amend the contract (e.g. a change of date or travel period) are not binding on the Organiser and may be accepted, where possible, up to 28 days before departure, subject to an administrative charge of €50.00 for each change; after that deadline, the cancellation charges under Article 10 apply. Replacing one tour with another is possible only by cancelling the original tour under the terms of Article 10 and making a new booking. In any event, the right to transfer the contract referred to in the preceding paragraph remains unaffected.
15. OBLIGATIONS OF THE TRAVELLER
- Travellers must possess a passport or other valid travel document for all countries included in the itinerary, together with any required visas and health certificates.
- Travellers must observe ordinary standards of care and diligence, the rules in force at the destinations, the information provided by the Organiser and the regulations and provisions applicable to the package; they are liable for damage suffered by the Organiser as a result of failure to comply with these obligations.
- The Traveller shall provide the Organiser with any documents, information and evidence in their possession that may be useful for exercising rights of subrogation against third parties responsible for the damage.
- At the time of booking, the Traveller shall notify the Organiser in writing of any special requests and any particular needs or conditions (e.g. pregnancy, food allergies or intolerances, disabilities, use of medical devices), specifying the personalised services requested. Special requests form part of the contract only if expressly accepted by the Organiser.
- The Traveller confirms that their own health condition, and that of any participants booked by them, is suitable for the characteristics of the trip communicated before conclusion of the contract.
16. ACCOMMODATION CLASSIFICATION
The official classification of accommodation establishments is indicated on the website, in the catalogue or in other information materials, on the basis of the classifications issued by the competent authorities in the country where the service is provided. Where no official classification exists, the Organiser provides its own description of the establishment, enabling the Traveller to assess and consequently accept it.
17. LIABILITY OF THE ORGANISER
The Organiser is responsible for the performance of the travel services included in the contract, regardless of whether they are provided by the Organiser itself or by other suppliers (Article 42 of the Tourism Code). The Traveller is entitled to an appropriate price reduction for any period during which there was a lack of conformity, unless the Organiser proves that the lack of conformity is attributable to the Traveller. The Traveller is also entitled to compensation for any damage sustained as a result of the lack of conformity, unless the Organiser proves that the lack of conformity is attributable to the Traveller, to a third party unconnected with the provision of the services and is unforeseeable or unavoidable, or to unavoidable and extraordinary circumstances (Article 43 of the Tourism Code). Where the breach is not of minor importance within the meaning of Article 1455 of the Italian Civil Code, the Traveller may claim, in addition to and independently of termination of the contract, compensation for damage arising from holiday time wasted and the loss of a non-repeatable opportunity (Article 46 of the Tourism Code). Personal injury is compensable in accordance with the international conventions to which Italy or the European Union is a party governing the individual services included in the package. Minors may participate in the trip only if accompanied by a legally responsible person.
18. LIMITS ON COMPENSATION
Compensation for damage other than personal injury resulting from the failure to perform, or improper performance of, the services included in the package may not exceed the limits laid down by the international conventions governing those services and Articles 1783 and 1784 of the Italian Civil Code. Any limitations on compensation do not apply to personal injury or to damage caused intentionally or negligently, and in any event may not be set at less than three times the total package price. In the event of loss of or damage to luggage, the Traveller must immediately report it to the Organiser. Within the limits set out above, the Organiser is not liable for: items not normally carried in luggage; payment instruments left unattended; superficial damage and damage to luggage handles and wheels. Transport of the Traveller’s own bicycles during the trip and transfers is at the Traveller’s risk. The trailer mounting equipment is designed for the Organiser’s bicycles: minor damage, especially to paintwork, may occur to third-party bicycles, for which the Organiser accepts no liability. This limitation also applies to transport services and tours provided by third parties.
19. BICYCLE AND SPORTS EQUIPMENT RENTAL
a) In the event of breakage, theft, loss or damage, the Traveller must compensate for the damage in accordance with the terms of the rental agreement.
b) In the event of theft, the Traveller must file a report with the competent authorities.
20. COMPLAINTS
The Traveller must report without delay any lack of conformity discovered during performance of the package (Article 42(2) of the Tourism Code) to the contact point indicated in the contract confirmation (tel. +39 0564 080511 – travel@rama1913.it), so that the Organiser, its local representative or tour leader can promptly remedy the situation. Failure to provide such notice may be taken into account for the purposes of Article 1227 of the Italian Civil Code.
21. INSURANCE AND INSOLVENCY PROTECTION
Unless expressly included in the price, Travellers are advised to take out insurance against costs arising from withdrawal or cancellation of the package, accidents and loss of luggage, as well as assistance cover for repatriation expenses in the event of accidents or illness. In the event of the Organiser’s insolvency or bankruptcy, payments made for services not provided and, where necessary, the Traveller’s repatriation are guaranteed by Garanzia Viaggi S.r.l., Via Nazionale 60, Rome – tel. 06 99705792, certificate No. A/79.6258/9/2025.
22. DISPUTE RESOLUTION
Pursuant to Article 67 of the Tourism Code, the Traveller may use voluntary or joint negotiation procedures or conciliation proceedings before arbitration or conciliation commissions established to resolve disputes between businesses and consumers concerning tourist services pursuant to Article 2(4)(a) of Italian Law No. 580 of 29 December 1993, with the assistance of consumer associations where appropriate, as well as alternative dispute resolution (ADR) procedures provided for in Articles 141 et seq. of the Italian Consumer Code. For complaints: travel@rama1913.it. If a dispute is not settled amicably, the courts of the place of residence or domicile of the Traveller acting as a consumer, where located in Italy, shall have exclusive jurisdiction (Article 66-bis of Legislative Decree No. 206/2005); where the Traveller does not qualify as a consumer, the Court of Grosseto shall have exclusive jurisdiction.
23. GOVERNING LAW AND REFERENCE TO APPLICABLE LAW
This contract is governed by Italian law. Matters not expressly addressed herein are governed by the Tourism Code, the Italian Civil Code and other applicable legislation.
24. FINAL PROVISIONS
This contract supersedes all previous agreements, understandings or negotiations, whether written or oral, between the parties relating to the same subject matter. The invalidity or unenforceability of individual clauses shall not affect the validity of the contract as a whole. In the event of clerical, printing or calculation errors, the Organiser reserves the right to correct the offer before conclusion of the contract. These general terms and conditions are drawn up in Italian and English; in the event of difficulties in interpretation, the Italian version shall prevail.
25. INDIVIDUAL TRAVEL SERVICES AND LINKED TRAVEL ARRANGEMENTS
Contracts covering only transport, only accommodation or any other individual travel service do not constitute a travel package, do not benefit from the protections afforded to packages under the Tourism Code and are governed by the contractual terms of the individual supplier, who is responsible for proper performance of the service. In the case of linked travel arrangements, the Traveller benefits from protection providing reimbursement of payments received for services not performed owing to the insolvency of the trader who collected the payments; this protection does not provide any reimbursement in the event of insolvency of the relevant service provider.
26. MANDATORY NOTICE PURSUANT TO ARTICLE 17 OF ITALIAN LAW NO. 38/2006
Italian law punishes offences relating to child prostitution and child pornography with imprisonment, even when such offences are committed abroad.
SPECIFIC APPROVAL OF CLAUSES (ARTICLES 1341 AND 1342 OF THE ITALIAN CIVIL CODE)
Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the Traveller specifically approves, by means of a dedicated and separate checkbox during booking, the following articles: 6 (Payments – confirmatory deposit and express termination clause); 8 (Changes before departure – response deadline and deemed acceptance in the absence of a reply); 10 (Withdrawal by the Traveller and cancellation charges); 14 (Transfer of the contract and changes requested by the Traveller); 15 (Obligations of the Traveller); 18 (Limits on compensation); 22 (Dispute resolution – competent court).
